Who Pays for an Uber/Lyft Accident?
Like any car accident case, Uber and Lyft accident claims depend on liability. Determining who is liable for the accident will determine who you should file a claim against, as well as how much compensation you may be entitled to receive. Note that liability is not the same as fault; liability is a legal issue regarding who is responsible for compensating personal injury victims. Because neither Uber nor Lyft classify their drivers as “employees,” they are not technically liable when their drivers cause accidents.
However, both Uber and Lyft do offer insurance coverage for accidents.
Uber and Lyft offer the following coverage in the following situations:
- If the rideshare driver does not have the app turned on and has not accepted a ride, the rideshare company is not liable. To recover compensation, you will need to file a claim with your own insurance provider or with the at-fault driver’s insurance provider, just like any other type of car accident claim.
- If the rideshare driver has the app turned on but have not yet accepted a ride, Uber/Lyft will cover up to $50,000 per person in bodily injury coverage, up to $100,000 per accident in bodily injury coverage, and up to $25,000 per accident in property damage (this does not include damage to the rideshare driver’s vehicle).
- If the rideshare driver has the app turned on and has accepted a ride or has a passenger in the vehicle, Uber and Lyft offer up to $1 million in liability coverage.
This coverage only kicks in once the driver’s own auto insurance coverage has been exhausted. So, after an accident, you will first need to seek compensation through the Uber/Lyft driver’s own auto insurance policy and, once this coverage has reached its limit, you may seek additional compensation through Uber/Lyft’s policy.
