What to Do After a Fatal Hit-and-Run in Missouri

When a driver flees, the family's primary path to justice often involves a Wrongful Death claim filed through their own Uninsured Motorist (UM) coverage. Because the "unknown vehicle" is treated the same as an uninsured driver, this coverage provides the financial support needed for funeral costs and the loss of a loved one when the at-fault driver cannot be found.

Missouri law requires all drivers to carry Uninsured Motorist (UM) coverage. In a hit-and-run scenario where the driver is never identified, the victim's own auto insurance policy steps in to provide compensation.

If the victim or a resident relative he lived with had an auto policy, that insurance acts as the at-fault party's coverage. It can pay for the family's wrongful death damages, including funeral expenses and the emotional loss of companionship.

The Missouri State Highway Patrol (MSHP) uses debris analysis to identify fleeing vehicles. Small fragments of plastic from a headlight or a side-view mirror often contain serial numbers that reveal the exact year, make, and model of the car.

Be sure to secure the crash report as soon as it is finalized, as it will contain these forensic details that your insurance company will need to verify the hit-and-run claim.

Additionally, Missouri follows Pure Comparative Fault, meaning a recovery is possible even if the pedestrian was partially responsible. However, if a driver strikes someone and flees, it is much harder for their insurance company to shift blame. Leaving the scene of a fatal accident is a criminal act that strongly suggests the driver was trying to hide negligence, such as intoxication or distraction.

It can be an immense burden to navigate the legal process while grieving. An attorney familiar with Missouri law can take over all communication with insurance carriers, ensuring the family is treated with respect and that their rights are protected.
