Who Can File a Wrongful Death Claim in Missouri?

Missouri law allows certain family members to file a wrongful death claim after a fatal crash. Spouses, children, and parents hold the highest priority for filing. If none of these relatives exist, siblings or their descendants may also file.

Missouri law establishes a clear priority order when multiple family members may be eligible to file. The spouse and minor children typically proceed first when both are present. Courts follow this order to avoid disputes over who leads the claim.

In some situations, no eligible family member files a wrongful death claim. A court can appoint a plaintiff to bring the claim on behalf of the estate. The appointment process requires court approval before any legal action proceeds.

Missouri law sets a three-year deadline to file a wrongful death claim after death. This period typically begins on the date of the person’s death. Missing this deadline can permanently bar surviving family members from pursuing a claim.

Wrongful death claims in Missouri may cover a range of financial and personal losses. Economic damages include medical expenses, funeral costs, and lost income the deceased would have earned. Non-economic losses include grief, loss of companionship, and emotional suffering experienced by survivors.

Several factors influence how a wrongful death case develops over time. Witness statements, crash reports, and medical records all carry weight in court. The circumstances of the fatal accident can affect both liability and the amount recoverable.

A wrongful death attorney helps eligible family members understand all of their legal options. A lawyer can identify who holds filing priority and handle required legal procedures. Legal guidance reduces the risk of mistakes that could affect the outcome of your claim.
