Navigating Insurance Limits with Multiple Victims in Missouri
In Missouri, accidents involving multiple injured parties, such as the collision on I-49, present significant challenges when the at-fault driver’s insurance is insufficient to cover everyone's losses. Missouri law requires minimum liability limits of $25,000 per person and $50,000 per accident. When several people are seriously injured or killed, these limits can be exhausted almost immediately.
In such cases, the insurance company may file an interpleader action, asking a court to decide how to distribute the limited funds among the victims, often using a "pro rata" basis according to the severity of each person's injuries.
To bridge the gap between these limited funds and the actual cost of recovery, victims may turn to Underinsured Motorist (UIM) coverage. This is an optional but vital portion of your own auto policy that kicks in when the at-fault driver's insurance is maxed out.
While Missouri mandates Uninsured Motorist (UM) coverage, UIM is a separate contractual benefit. Identifying whether your policy provides "gap" coverage (the difference between policies) or "excess" coverage (additional funds on top of the other driver's limits) is essential for understanding your financial options.
Additionally, Missouri's Joint and Several Liability rules offer protection if a second party is found even partially at fault. Under Missouri Law, if any defendant is found to be 51% or more responsible, they can be held liable for the entire amount of the victims' compensatory damages, regardless of the other parties' ability to pay.
Because evidence like vehicle "black box" data or toxicology reports can vanish or be destroyed, legal professionals often use spoliation letters to force the preservation of this information.
Securing these records early is the only way to ensure all potential layers of insurance are identified to cover the extensive medical and funeral expenses following a catastrophic crash.
