What Happens After a Fatal Pedestrian Accident in Wisconsin?

After a fatal pedestrian accident in Wisconsin, investigators typically begin a detailed review of the crash scene to determine how the collision occurred. Police officers may document the location of the vehicle, examine roadway conditions, and collect physical evidence such as debris, skid marks, and damage to the vehicle involved.

Witness statements are often gathered from people who may have seen the crash or events leading up to it. Investigators may also review surveillance footage from nearby businesses, residential security cameras, or traffic cameras to better understand how the incident unfolded.

Accident reconstruction specialists are sometimes brought in to analyze the evidence in greater detail. These experts may evaluate vehicle speed, braking distance, and the point of impact to help determine whether the driver had time to react before the collision occurred.

Investigators may also consider environmental factors such as lighting conditions, visibility, weather, and traffic signal timing.

Wisconsin follows a fault-based system for motor vehicle accidents. This means the driver found responsible for causing the crash may be held financially liable for damages resulting from the incident.

Insurance companies often conduct their own investigations as well, reviewing police reports, medical findings, and other evidence before determining how claims will be handled.

Families affected by fatal pedestrian accidents may face difficult financial and legal questions in the aftermath of the tragedy. In certain situations, surviving relatives may be able to pursue a wrongful death claim seeking compensation for losses such as funeral expenses, medical costs incurred before death, loss of financial support, and loss of companionship.

Because these cases can involve complex legal and insurance issues, some families choose to speak with a lawyer to better understand their rights. A Milwaukee wrongful death attorney can outline what types of compensation may be available under state law.
