What To Do If a Family Member is Killed in a Car Accident in Missouri
When a car accident results in a fatality in Missouri, the legal process focuses on a "Wrongful Death" claim. To protect your family, you must identify who is legally allowed to file the claim, preserve evidence from the vehicles involved, and look into all available insurance policies to cover the immense losses.
The first step is understanding who has the right to bring a legal claim. In Missouri, the law divides survivors into classes. The first class includes the surviving spouse, children (or their descendants), and the parents of the person who passed away. If no one from this group exists, a sibling may be able to file. This legal action is meant to provide financial support for the family and to honor the "full value" of the life that was lost.
Preserving evidence is the next critical priority. This involves securing the data from the vehicles’ "black boxes," or Event Data Recorders. This data can prove exact speeds, braking patterns, and whether there were any mechanical failures. Because these vehicles are often moved to salvage yards quickly, sending a legal notice to preserve them is a time-sensitive task.
Families must also navigate the financial aftermath, which includes funeral costs and the loss of the deceased person’s future wages and benefits. Missouri law allows families to seek compensation for the "loss of consortium," which represents the loss of companionship, comfort, and guidance the family member provided. While no amount of money can replace a loved one, these funds are designed to ensure the surviving family members are not burdened by debt following the tragedy.
Finally, it is essential to look at all insurance options. If the at-fault party’s insurance is not enough to cover the family’s needs, or if there is a dispute over fault at the intersection, you may need to use Underinsured Motorist (UIM) coverage. This is an optional part of many Missouri auto policies that provides an extra layer of protection when a tragedy exceeds the standard policy limits.
