Who Can File a Wrongful Death Claim in Tennessee?

In Tennessee, certain family members can file a wrongful death claim after a fatal accident. Usually, the deceased person’s spouse, children, or next of kin may have the legal right to bring a claim when another party’s negligence causes a death.

Wrongful death laws allow surviving family members to seek financial compensation after losing a loved one due to a preventable accident. These claims aim to address both the emotional loss and the financial hardship that often follows a fatal crash.

In many cases, the surviving spouse receives the first right to file a wrongful death lawsuit. If the victim was not married, the right may pass to children or other close relatives. Tennessee law may also allow a personal representative of the estate to file a claim on behalf of the surviving family members.

A wrongful death claim can include several types of damages. Families may pursue compensation for medical expenses related to the victim’s final injury, funeral and burial costs, and the loss of financial support the deceased person provided. Courts may also consider the emotional loss suffered by surviving family members.

Evidence plays an important role in wrongful death claims. Investigators often rely on police reports, witness statements, medical records, and accident scene documentation. These details can help determine liability and show how the crash occurred.

Because these cases involve complex legal rules and strict deadlines, many families seek guidance from a legal professional after a fatal crash. A wrongful death attorney can review the facts of the accident, explain who may file the claim, and outline the legal options available under Tennessee law.
