Who Can File a Wrongful Death Claim in Tennessee?

In Tennessee, certain close family members can file a wrongful death claim after a fatal accident. State law generally allows a surviving spouse, children, or next of kin to pursue a claim. If no immediate family member files, a personal representative of the estate may step in.

Wrongful death claims often arise after serious events such as a truck crash or head-on collision. These cases focus on financial and legal losses connected to the death. Compensation may include funeral costs, final medical bills, and lost income the person would have earned. Tennessee law sets specific rules about who has priority to file and how damages are distributed.

Families must also pay attention to deadlines. Tennessee typically applies a one-year statute of limitations in wrongful death cases. Missing that deadline can limit available legal options. Early legal review helps families understand timelines, required documentation, and how insurance coverage may apply.

A wrongful death case may involve reviewing crash reports, medical records, and employment information. A wrongful death attorney can explain how these documents support a claim and outline what types of compensation may be available under state law. Clear guidance helps families understand the process without adding confusion.
