Missouri Fault and Liability Laws
Missouri operates under a "pure comparative fault" system, which is highly significant in complex accidents involving multiple parties or pedestrians on high-speed roadways. Under this rule, an injured person (or their estate) can recover damages even if they are partially responsible for the accident. However, the total financial recovery is reduced by their exact percentage of fault. For example, if a jury determines a pedestrian was 40% at fault for being in the roadway and a driver was 60% at fault for failing to avoid the collision, the victim's family could still recover 60% of the total damages.
In "second-impact" collisions like this one, establishing the sequence of events is vital for determining liability. If the first vehicle struck the pedestrian and fled the scene, the victim's family may be able to pursue a claim through uninsured motorist coverage. Additionally, liability for the second driver depends on factors such as their speed, reaction time, and whether they were maintaining a proper lookout.
If the accident results in a fatality, Missouri’s Wrongful Death statute allows specific family members, such as a spouse, children, or parents, to file a lawsuit for financial losses, funeral expenses, and "aggravating circumstances" if the driver’s conduct was exceptionally reckless.
A wrongful death attorney acts as an essential advocate during the investigation of a fatal multi-vehicle accident. They can coordinate with the local police department to gather forensic evidence, interview witnesses, and employ accident reconstruction experts to determine the precise timing of each impact. By managing the complex legal and insurance filings, an attorney allows the family to focus on their grieving process while ensuring all responsible parties are held accountable.
